Instructions on Withdrawal
Consumers are entitled to the following right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods. To exercise your right of withdrawal, you must inform us (High-End-More · HEM-AUDIO, Dejan Petek, Emilienstraße 72, 42287 Wuppertal, Germany, e-mail: high-end-more@dejan-petek.de) of your decision to withdraw from this contract by means of an unequivocal statement (for example a letter sent by post or an e-mail). You may use the model withdrawal form set out below, but this is not obligatory. To meet the withdrawal period, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we must reimburse to you all payments we have received from you, including the delivery costs (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract reached us. For this reimbursement we will use the same means of payment that you used for the original transaction, unless something else has been expressly agreed with you; under no circumstances will you be charged any fees on account of this reimbursement. We may refuse reimbursement until we have received the goods back or until you have supplied evidence that you have sent the goods back, whichever is the earlier.
Return and compensation for loss of value
You must send the goods back to us or hand them over to us without undue delay and in any event at the latest within fourteen days from the day on which you notify us of the withdrawal from this contract. The period is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. In the case of devices that by their nature cannot normally be returned by post, you likewise bear the direct costs of return; these are estimated at a maximum of approximately 400 EUR. You only have to compensate for any loss in value of the goods if this loss in value is attributable to handling of the goods that was not necessary to establish their nature, characteristics and functioning.
Exclusion and early expiry
The right of withdrawal does not exist in the case of contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive, or that are clearly tailored to the personal needs of the consumer. This concerns in particular custom-made items and individually commissioned conversions or paint finishes. Contracts concluded exclusively on site on our premises are not distance contracts; no statutory right of withdrawal exists in such cases.
